Litigation & Disputes

When business relationships break down, you need a lawyer who can fight effectively in US courts. With nearly 20 years of litigation experience representing both plaintiffs and defendants, I bring aggressive advocacy and strategic judgment to complex commercial disputes.

Overview

Overview

I represent businesses in complex commercial litigation, from pre-litigation strategy through trial and appeal. My approach is aggressive but strategic - I fight hard for clients while recognizing when settlement serves their business interests better than prolonged litigation.

With experience representing both plaintiffs and defendants, I understand both sides of commercial disputes. Whether you're seeking to recover damages, defending against claims, or navigating a business divorce, you get counsel from someone who has tried cases and won on both sides.

Raised in the US with deep roots in the Asian business community, I've litigated matters involving all-Mandarin speaking parties and negotiated resolutions across cultural divides. When language and culture matter, I am experienced in both.

Areas of litigation include:

  • Contract Disputes & Breach of Contract: Enforcement and defense of commercial contracts, supplier agreements, distribution contracts, service agreements, purchase/sale disputes.

  • Business Divorce & Shareholder Disputes: Partner breakups, shareholder oppression claims, derivative actions, buyout disputes, ownership conflicts.

  • Collections & Debt Recovery: Commercial collections, judgment enforcement, debtor asset investigation, domestication of foreign judgments.

  • Fraud & Business Torts: Fraudulent inducement, misrepresentation, breach of fiduciary duty, tortious interference, unfair competition.

  • Real Estate Disputes: Landlord-tenant litigation, lease disputes, commercial evictions, purchase/sale contract disputes.

  • Employment Litigation: Non-compete enforcement, trade secret protection, wage disputes, wrongful termination defense.

  • Cross-Border Disputes: Multi-jurisdiction litigation, international contract disputes, foreign judgment enforcement, arbitration.

Experience

Experience

  • Lien-Sheng Chen et al. v. Sung-Chieh Chen et al. (Suffolk County Superior Court)          Obtained judgment exceeding $1.88 million for client after four-day bench trial in complex cross-border real estate dispute involving parties in the US and Taiwan. Successfully established through resulting trust theory that client was the intended beneficiary of her late father's investment in a Boston condominium, securing recovery of the full $1,875,000 capital contribution plus 50% of profits from the sale. The court credited documentary evidence and rejected opposing testimony that sought to characterize prior wire transfers as evidence of a different ownership arrangement.

  • Blue Fuji Bedford v. Xie et al. (Middlesex County Superior Court)
Secured $183,248 judgment after bench trial for closely-held business client in shareholder dispute involving misappropriation of company funds. The court found defendant, as President, breached his fiduciary duty of utmost good faith and loyalty to the minority shareholders by taking $150,000 from the company for personal use without proper disclosure. Successfully proved breach of contract, breach of fiduciary duty, and unjust enrichment.

  • Ivymedia Corporation v. Ilikebus, Inc. et al. (US District Court, District of Massachusetts)
Obtained complete defense verdict after federal jury trial in copyright infringement case involving competing online bus ticketing platforms. Plaintiff claimed defendants copied protected elements of its website design and functionality. Successfully argued at summary judgment that many of the allegedly copied elements were unprotectable under the Copyright Act's exclusion of "methods of operation" and the doctrine of scènes à faire. After surviving claims proceeded to trial, secured jury verdict for defendants on all counts.

  • Lubrizol Advanced Materials Inc. v. Duro Textiles LLC (Bristol County Superior Court)
Domesticated foreign judgment and successfully effectuated trustee process attachment, securing recovery for client through strategic post-judgment enforcement.

  • Kai Qin Chen v. Kai Cheng Chen (Middlesex County Superior Court)                          Prevailed after nine-day bench trial in consolidated real estate and eviction dispute between family members. Successfully defended client against claims seeking to establish a resulting trust over Newton residential property and defeated all contract claims. The court found that client was the true purchaser and sole owner of the property, rejecting opposing testimony regarding alleged oral agreements. Obtained $57,600 judgment on counterclaims for use and occupancy, plus possession of the property with ongoing monthly payments until defendant vacated.

  • Metropolitan Linen Services Corp. v. Vinny T's Restaurant Corp. (Middlesex County Superior Court)
Successfully enforced liquidated damages provision in commercial contract dispute.
